GO NINJA – ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION AGREEMENT Go Ninja activities involve physical movement, obstacle elements, climbing, balancing, jumping, and other recreational fitness challenges. While these activities offer many benefits, they also include inherent risks of injury. This agreement ensures that the adult participant and/or parent/legal guardian of a minor participant (collectively, “PARTICIPANT/PARENT”) understands, accepts, and assumes these risks. Inherent Risks of Go Ninja Activities Go Ninja activities involve physical activity in a dynamic environment. Inherent risks include, but are not limited to: Falls, even on padded surfaces Collisions with other participants or stationary objects Landing incorrectly on jumps, vaults, leaps, or obstacles Landing on another participant Over-exertion or attempting maneuvers beyond one’s ability Slips, trips, and falls in activity or non-activity areas Equipment malfunction or unexpected movement of padding Erratic or careless behavior by self or other participants Judgment or supervisory errors by staff (e.g., spotting, assessing ability, hazard recognition) Types of Injuries Go Ninja believes it is important for participants to understand the three general categories of injuries that may occur: Minor Injuries Examples: strains/sprains, bruises or contusions, abrasions, blisters, rope burns. Serious Injuries Examples: broken bones, ligament injuries, dislocations, concussions, severe sprains, eye injuries. Catastrophic Injuries Examples: brain injury, paralysis, heart attack, and in extremely rare cases, death. Assumption of Risk I, the PARTICIPANT/PARENT, acknowledge that Go Ninja activities contain inherent risks that vary with the activity. I understand the demands of these activities relative to my, or my minor child’s, physical condition, experience, and skill level. I knowingly and voluntarily assume all inherent risks associated with Go Ninja activities. Waiver of Liability In consideration of permission to participate in Go Ninja activities and use the facility, today and on all future dates, I, the PARTICIPANT/PARENT, on behalf of myself, my spouse, heirs, parents, guardians, personal representatives, and assigns (collectively, “Releasing Parties”), hereby: Release, waive, discharge, and covenant not to sue Go Ninja, LVLUP Martial Arts (Waunakee or Verona), their owners, directors, officers, affiliates, employees, volunteers, independent contractors, equipment providers, agents, and facility owners (collectively, “Protected Parties”) from: Any and all claims resulting from personal injury or death related to participation in Go Ninja activities or use of the facility/equipment. Any and all claims for damage to, loss, or theft of property. Indemnification Agreement I, the PARTICIPANT/PARENT, further agree to hold harmless, defend, and indemnify the Protected Parties from any and all claims or causes of action brought by: Releasing Parties, other participants, rescuers, or any third parties arising from my participation or my minor child’s participation in Go Ninja activities, including costs, judgments, attorney’s fees, and related expenses. Clarifying Clauses This agreement supersedes all prior oral or written agreements or statements. No modification is valid unless in writing and signed by Go Ninja management. This agreement is intended to be as broad and inclusive as permitted under Wisconsin law. If any portion is deemed invalid, the remainder shall continue in full legal force and effect. Mandatory Binding Arbitration Any claim arising from or related to participation in Go Ninja activities— including personal injury or death — shall be submitted to binding arbitration under the rules of the American Arbitration Association. Venue: Dane County, Wisconsin Applicable Law: State of Wisconsin PARTICIPANT/PARENT understands this is a waiver of the right to a jury trial. Forum Selection Clause Any legal action challenging the validity or interpretation of this agreement must be filed exclusively in the Dane County Circuit Court, Dane County, Wisconsin. PARTICIPANT/PARENT expressly consents to this jurisdiction and venue. Rules and Participant Responsibilities To promote a safe environment, PARTICIPANT/PARENT agrees to: Rules & Actions Obey all safety rules and instructions from staff. Immediately report unsafe behavior or hazards to staff. Remain only in designated activity areas. Stop activity and notify staff immediately if experiencing discomfort, dizziness, anxiety, or pain. Attempt only skills or obstacles that feel safe and within personal ability. Health & Safety Obtain medical clearance if needed before participating in vigorous physical activity. Possess sufficient physical ability and skill for safe participation. Have no health issues that would make participation unsafe. Authorize Go Ninja/LVLUP staff to administer first aid or CPR. Authorize Go Ninja/LVLUP staff to secure EMS or emergency medical care when necessary and agree to assume all associated costs. Photo/Video Release PARTICIPANT/PARENT authorizes Go Ninja / LVLUP Martial Arts to use photos or video captured during participation for marketing, advertising, and electronic/print media. Acknowledgment of Understanding I, the PARTICIPANT/PARENT, acknowledge and agree: I have carefully read this entire Agreement. I understand I am giving up substantial legal rights, including the right to sue the Protected Parties. I am voluntarily signing this agreement without duress. If signing as Parent/Guardian of a minor, I have explained the risks and rules to my child and confirm that they understand and agree to follow them. My digital signature represents my full and unconditional agreement to the terms above.
